PROSPECTIVE MARRIAGE – SUBCLASS 300 VISA (FIANCÉ(E) VISA)

If you are an Australian citizen, permanent resident or an eligible New Zealand citizen aged 18 or over and engaged to be married, you may be eligible to bring your Fiancé/Fiancée to Australia on a temporary Prospective Marriage (Subclass 300) visa to marry and live with them in Australia for 9 months.

After you are legally married and before the subclass 300 visa has expired, you and your spouse may be eligible to apply for an onshore Partner visa (Subclass 820/801).  The FREE essential 300 fact sheet below can provide more details on visa requirements.

FAMILY MEMBERS AND SUBCLASS 300 VISA

You may also apply to bring your fiancé(e)’s children and step-children to Australia via the same visa, who are either:

  • Under 18 years old and have no fiancé(e), spouse or de facto partner or

  • Between 18 to 22 years old, dependent and have no fiancé(e), spouse or de facto partner or

  • 23 years old or older, dependent because are they is incapacitated for work due to the total or partial loss of the first person’s bodily or mental functions and have no fiancé(e), spouse or de facto partner

WHAT IS THE PROCESSING TIME?

The length of time for a decision varies from case to case and can depend on such factors as quantity of visa applications for that subclass, chronological order of lodgement, applicants risk assessment, case complexity and staffing number at the visa processing centre.

IF THE SUBCLASS 300 VISA IS GRANTED

Should your subclass 300 visa be approved you will be granted a temporary visa which allows your fiancé(e) to travel to Australia before being legally married, stay and work in Australia for 9 months.

You may get married inside or outside Australia. If marrying outside Australia your fiancé(e) must first enter Australia before being married, then leave to marry and ensure to return to Australia before the subclass 300 visa expiry date.

After you are legally married and return to Australia before the subclass 300 visa has expired, you and your spouse may be eligible to apply for an onshore Partner visa (Subclass 820/801).
